Notice To Purchasers of Special Taxing or Assessment District

Why Green Valley Special Utility District (GVSUD) does not provide a “Notice To Purchasers of Special Taxing or Assessment” on this website.

  • The Texas Real Estate Commission (TREC) requires some sellers of property to give a special notice to buyers before a contract can be signed.
  • Green Valley SUD (GVSUD) is not required to provide this notice because we are not covered by the “Notice to Purchasers” rule in Texas Water Code Section 49.452.

Why GVSUD Is Not Required to Provide the Notice

  • GVSUD is created under Texas Water Code Chapter 65, which meets the first part of the definition of a “district” in Texas Water Code Section 49.452(a)(2).  
  • However, the definition of “district” would only apply to GVSUD if its meets the second part of the Section 49.452(a)(2) definition by either having taxing authority or by adopting a standby fee.
  • Special utility districts such as GVSUD do not have taxing authority.
  • GVSUD has not adopted and does not charge a standby fee.
  • Because GVSUD does not levy taxes and does not impose a standby fee, the requirements of Texas Water Code Section 49.452 do not apply to GVSUD.
